Terms & Conditions – Maison Montreal
Article 1 – Definitions
In these Terms and Conditions, the following definitions apply:
Return Period / Cooling-Off Period:
The period within which the consumer may return a product in accordance with the return policy of the entrepreneur.
Consumer:
Any natural person acting for purposes outside their trade, business, or profession who enters into a distance contract with the entrepreneur.
Entrepreneur:
The natural or legal person established in the Netherlands who offers products for sale via an online sales channel.
Distance Contract:
A contract concluded through electronic means, without the simultaneous physical presence of consumer and entrepreneur.
Terms & Conditions:
These present Terms and Conditions of the entrepreneur.

Maison Montreal operates from the Netherlands and offers products internationally, including to consumers located in Canada.
Article 3 – Applicability
These Terms and Conditions apply to all offers, orders, and distance contracts concluded via the webshop of the entrepreneur.
Before concluding the contract, the consumer is clearly informed of these Terms and Conditions and is able to store them on a durable medium.
If any provision of these Terms and Conditions is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Article 4 – The Offer
The offer contains an accurate description of the products offered. Images are for illustrative purposes only; colours and details may vary depending on screen settings.
Obvious errors or mistakes in the offer do not bind the entrepreneur.
Prices displayed do not include possible import duties, customs charges, local taxes, or other fees applicable in the country of delivery. Such costs are the responsibility of the consumer.
Article 5 – Formation of the Contract
The contract is concluded at the moment the consumer accepts the offer and payment is successfully completed.
After placing an order, the consumer receives an electronic order confirmation.
The entrepreneur reserves the right to refuse or cancel orders for valid reasons, including but not limited to payment issues or incorrect customer information.
Article 6 – Return Policy
The entrepreneur offers a 30-day return policy starting from the day the consumer receives the product.
This return policy is a commercial policy of the entrepreneur and does not affect any mandatory consumer rights applicable in the consumer’s country of residence, including Canada.
To initiate a return, the consumer must contact customer service within 30 days of receipt via email.
Returned products must be unused, undamaged, and—where reasonably possible—returned in their original packaging.
Unless otherwise stated, return shipping costs are borne by the consumer.
Article 7 – Refunds
After receipt and inspection of the returned product, the purchase amount will be refunded within 14 days via the original payment method, provided the return conditions have been met.
Article 8 – Exclusions from Return
Returns are excluded for:

Personalized or custom-made products

Hygienic products where the seal has been broken

Products that, due to use, can no longer be sold as new
Article 9 – Prices and Payments
All prices are displayed in the currency selected on the website (for example CAD).
The entrepreneur is not responsible for exchange rate differences or additional costs charged by banks or payment providers.
Article 10 – Delivery
The entrepreneur aims to deliver orders within the indicated timeframes. Delivery times are indicative and may vary due to external factors such as customs procedures, carriers, or weather conditions.
The risk of loss or damage to the product transfers to the consumer upon delivery.
Article 11 – Complaints
Complaints should be submitted within a reasonable time after discovery via customer service.
The entrepreneur will handle complaints as quickly as possible and aims to find an appropriate solution.
Article 12 – Governing Law
These Terms and Conditions are governed by Dutch law.
This choice of law does not affect any mandatory consumer protection rights available under the laws of the consumer’s country of residence, including applicable Canadian consumer protection legislation.
